2. Who are we?
Any reference to "we", "us", "our" and “Ramshackle” is to Ramshackle Productions Limited (Company no. 09443758). We are known as the “data controller” of your personal data and you are always welcome to contact us at info@ramshackleproductions.co.uk for more information about how we process your data, including how to exercise your rights as a data subject.
We believe user privacy and data protection are human rights and that we have a duty of care to the people within our databases. Data is a liability, it should only be collected and processed when absolutely necessary. We will never sell, rent or make public your personal information.
3. Your personal data
The information we process may include but are not limited to your name, address, email address, IP address, gender, date of birth, age, phone number, passport details or other national identifier, driving license, your national insurance or social security number and income, employment information and details about your previous roles and personal history.
We collect information about you from a number of sources, including from you directly, please see below for further information.
3.1 Information that you give us:
From any document that you complete when you apply for a role or part in, or contribute to, a programme or film when you provide it to us in correspondence and conversations when you apply, participate or contribute to a programme or film, and you provide information which is relevant to your application or contribution. (e.g. phone correspondence, pre-production questionnaires and release forms)
The information we collect will depend on the nature of the production, where relevant this can also include special category data such as medical information, political opinions, sexual orientation and where relevant your criminal history. The nature of the production and the information which we will be asking you for will be explained to you in advance.
3.2 Information we obtain through others:
Publicly available and accessible directories and sources such as social media platforms, including Facebook, Instagram, Twitter and Linkedin.
Governmental and competent regulatory authorities to whom we have regulatory obligations.
Agents and production companies.
Fraud prevention and detection agencies and organisations and where we need to do so for regulatory purposes, and this is in the public interest, crime enforcement and criminal records agencies.
4. How do we use this information?
We collect information about you to assess your suitability to contribute and participate in a programme, film or general production.
If you are selected to participate in one of our programmes, films or productions we will use the personal information you have provided us for the purposes of developing, producing, distributing and administering the programme or film you have chosen to participate in.
Your personal information will not be used for any marketing or sales purposes. However we may, subject to your agreement, contact you about other programmes or films we think you may be interested in.
5. How do we use this information?
Regardless of how we use your information, we will make sure that such use complies with all laws and regulations relating to the protection of personal data. Such laws and regulations allow us to use personal data for a variety of reasons.
These reasons include:
In order to perform our contractual obligations with our clients, customers and suppliers where we have obtained your consent.
In order to discharge our legal and regulatory obligations.
In order to establish, exercise or defend our legal rights or for the purpose of legal proceedings as is necessary for our legitimate business interests, such as:
Allowing us to effectively and efficiently manage and administer the operation of our business (this being the development, production and distribution of television programs, films, music videos and other video content productions)
To commercially make full use of either programme, film or clips thereof in the UK and around the world, for the period in which we have rights in the programme or film. We also keep an archive copy of the programme or film after our rights have expired; to share with our professional advisors and/or the commissioning entity or commissioning broadcaster that we are producing the programme or film for, any co-producer that we are producing the programme or film with, and/or any financier of the programme or film.
Maintaining compliance with internal policies and procedures and monitoring the use of our intellectual property.
6. Who do we share your information with?
Your information will be used by the relevant production team for the purposes of producing the programme or film.
It may also be shared internally and externally with relevant teams in order to prepare contractual documentation or provide legal advice, organise payment, comply with any distribution regulations as well as ensure health and safety and insurance compliance where required.
We may also pass your information to our third-party service providers such as agents, subcontractors and other associated organisations for the purposes of facilitating your application for and inclusion in a programme or film you are interested in taking part in.
This also includes the police or other regulatory bodies as required by law in connection with the investigation of crimes. Although we are based in the UK, our business is global and so we may need to transfer your personal information outside the UK. Wherever your information is transferred to organisations outside the UK, we will ensure that adequacy regulations or appropriate safeguards, such as standard data protection clauses recognised or issued in accordance with the UK data protection regime, are in place to ensure the safety and security of your personal information and that it is processed in accordance with this privacy notice (unless an exemption applies).
However, when we use third party service providers, we disclose only those elements of your information that are necessary to deliver the required service.
We will not share your personal information with any third parties, unless you give us your consent to do so or we are authorised to do so by law.
7. How do we store your data?
We do not retain your information for longer than necessary for the purpose it was collected.
We keep your personal data for as long as it is required by us for our legitimate business purposes, to perform our contractual obligations, or where longer, such longer period as is required by law or regulatory obligations which apply to us.
In general we keep your information only for the period we have legal rights to exploit the programme that your information relates to. We will usually delete your personal information at the end of that period, but it is likely this period will be a minimum of 6 years.
We have implemented appropriate measures to ensure that your personal information is kept safe and secure e.g. by storing it securely, and by keeping electronic data on secure servers and hard drives with appropriate levels of security.
However, the internet is an open system and we cannot guarantee that unauthorised third parties will never be able to defeat those measures. For those participating in our programmes, we are likely to retain your personal information for as long as is necessary in order to produce, exhibit, exploit, distribute, advertise, publicise and promote the programme in accordance with our legitimate interests and legal obligations.
Personal information that is no longer required will be deleted/destroyed.

8.1 The Special Purposes – public interest journalism//in pursuit of artistic purposes
Please note that the UK GDPR and DPA 2018 state that in certain circumstances we do not have to comply with some aspects of data protection law (including this privacy notice) if we believe that doing so would be ‘incompatible’ with journalism and/or artistic purposes (i.e. it would stop us from doing our job as a producer of Content), data is being held with a view to publication, and there is a public interest in publication. This is known as the ‘special purposes exemption’. We may process your personal data under the special purposes exemption in connection with Content. References in the above table to ‘processing undertaken in connection with public interest journalism/in pursuit of artistic purposes’ includes processing where we rely upon the special purposes exemption.
9. Your rights
You have rights in relation to the personal data we hold about you. These include the right to be informed, to access your data, to correct inaccurate information, to request deletion or restriction of processing, to object to processing (including for direct marketing), and to request data portability. You also have rights in relation to automated decision-making and profiling.
Where our processing is based on your consent, you may withdraw that consent at any time. This will not affect any processing carried out before consent was withdrawn, and your data may still be processed where another lawful basis applies.
If you wish to exercise any of your rights, please contact us using the details below. These rights are not absolute and apply only in certain circumstances. There is no fee for making a request, although we may charge a reasonable fee or refuse a request if it is clearly unfounded or excessive.
We may need to verify your identity before responding and aim to reply within one month.
10. Changes to our business
In the event we become involved in a merger, acquisition, restructuring, reorganisation or other transaction involving the sale of some or all of our assets, then your information may be included in the assets which are transferred to the new owner and may be provided to the entities and advisors involved.
If there are changes to our business (such as a reorganisation or restructuring), your personal information will remain subject to this privacy policy (as amended from time to time). However, where your personal information is transferred to a new owner following a merger or acquisition, it may be subject to a different privacy policy.
We, or the new owner, will provide notice to you (where practicable) before any of your personal information becomes subject to a different privacy policy.

We keep our privacy policy under regular review and we may change it from time to time in line with legislation or industry developments.
